Making the commitment to improve your financial situation by filing for bankruptcy is a big step. It creates a shift from hopelessness and harassment to positive action and self-control. However, not all bankruptcy filings run smoothly. One of the most important things you can do to ensure bankruptcy helps you build a brighter future is to work with an experienced bankruptcy attorney.

How do you find an attorney that is right for you? The process might take a bit of time, but knowing what to look for in a bankruptcy attorney and following your instinct regarding the right attorney can save you a great deal of time, money, and headaches.

Though the first attorney you speak to might be the one you hire, it is important to know your options. Most bankruptcy lawyers provide free consultations, which allow you to evaluate your situation and determine which path to take. Shopping around for an attorney ensures you make the best decision for you. There are plenty of qualified options, but not all bankruptcy lawyers are right for everyone declaring bankruptcy.

What should you ask during your free consultation? These questions can help you determine which bankruptcy lawyer is right for you:

• How long have you been practicing bankruptcy law?
• Do you handle any other types of cases? If so, is bankruptcy your specialty?
• Do you have experience with cases that are similar to mine?
• How much will it cost me to file for bankruptcy? Are there any other costs associated with the process? Do you offer payment plans?
• Will I work directly with you or someone else in your office? Can I meet that person?
• How much time does the bankruptcy process take?
• How will we communicate?

Your goal during a consultation is to determine if bankruptcy is the right choice for you and if the lawyer with whom you are speaking is the right person to help you with the process. You should feel comfortable speaking with the attorney and understand all of your options. If you are confused or feel pressured to file immediately, you should walk away and take some time to think about your situation. You do not want to make your decision solely based on an attorney pressuring you to do so.

You can also contact the local Bar Association for information on the attorney or to receive names of recommended practitioners.
